These Terms and Conditions ("Terms") apply to every booking, enquiry and use of the SkyTrips website, phone, email, WhatsApp and in-person services. Please read them carefully before you book. By making a booking, paying a deposit or using our website, you confirm that you have read, understood and agree to these Terms.
1. About us
SkyTrips is a trading name of A2link Business House Pty Ltd (ABN 56 648 310 258), a company registered in Australia with its address at 42 Rainbows Way, Leppington NSW 2179, Australia ("SkyTrips", "we", "us" or "our"). You can contact us at info@skytrips.com.au or on +61 447 193 619.
"You" and "your" mean the person making the booking and, where relevant, every traveller named in it.
2. Our role as your travel agent
SkyTrips is a travel agent. We arrange and sell travel products such as airline tickets, tours, hotels, airport transfers and visa assistance on behalf of third-party suppliers ("Suppliers"), including airlines, tour operators, accommodation and transfer providers.
- When you book, your contract for the travel itself is with the relevant Supplier, and the Supplier's own terms and conditions apply. For flights, this includes the airline's conditions of carriage and the fare rules of your ticket.
- We are responsible for providing our own booking and advisory services with due care and skill. We do not operate, own or control the Suppliers and are not responsible for the services they provide, except as required by law.
- Where a Supplier's terms conflict with these Terms in relation to the Supplier's service, the Supplier's terms prevail for that service.
3. Making a booking
- Quotes and availability. Quotes and prices shown on our website are subject to availability and can change until your booking is confirmed and paid and, for flights, your ticket is issued. Fares are controlled by airlines and may change or sell out without notice.
- Confirmation. A booking is confirmed only when we have received the required payment and sent you a written confirmation. For flights, a booking is not final until the airline ticket has been issued and you have received an e-ticket number.
- Accuracy of details. You must provide complete and accurate information for every traveller. Names must exactly match each traveller's passport. Correcting a name after ticketing may not be possible, or may require a new ticket at the current fare plus fees.
- Booking for others. If you book for other travellers, you confirm that you are authorised to do so and to accept these Terms on their behalf, and that they have agreed to their personal information being provided to us (see our Privacy Policy). You are responsible for payment for the whole booking.
- Age. You must be 18 or older to make a booking.
- Check your documents. Please review your confirmation, itinerary and e-ticket as soon as you receive them and tell us immediately about any error.
4. Prices, fees and surcharges
All prices are in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. Before you pay, we will show you the total price, including all compulsory fees and charges that we know of.
In addition to the Supplier's price, the following SkyTrips fees may apply and will be shown before you pay:
| Fee | Amount | When it applies |
|---|---|---|
| Booking and consultation fee | AUD 30 per ticket | Per airline ticket issued |
| Credit card surcharge | 1.5% of the amount paid | Payments by credit card |
| Visa processing fee | AUD 50 per person | Visa application assistance (excludes government visa fees) |
| Tour booking fee | AUD 25 per booking | Tour package bookings |
| Change service fee | AUD 25 per ticket | Each change we process at your request (plus any Supplier change fee and fare difference) |
| Cancellation and refund service fee | AUD 25 per ticket | Each cancellation or refund we process at your request (plus any Supplier cancellation fee) |
- Card surcharges. Our card surcharge reflects our reasonable cost of accepting that payment method and is applied in line with the Reserve Bank of Australia's surcharging standard and Australian Consumer Law.
- Service fees are for our services. Our booking fees pay for the work we do to research, book and issue your travel. They are separate from, and in addition to, Supplier charges.
- Change and refund fees. Suppliers may charge fees for changes, cancellations or refunds. In addition, our service fee for processing a change is AUD 25 per ticket, and for processing a cancellation or refund is AUD 25 per ticket. We will confirm all fees before you ask us to proceed. We do not charge these service fees where the change or cancellation is caused by our error, or where a Supplier cancels or significantly changes your booking.
- Taxes and currency. Airline taxes and charges may change before ticketing. Your card provider may charge international transaction or currency conversion fees; these are outside our control.
- Price errors. If a price is shown incorrectly due to an obvious error, we will contact you before confirming. You may then accept the correct price or cancel for a full refund of any money you have paid us for that booking.
5. Payment
- Payments are processed securely by our payment providers, including BPoint (for Australian card payments) and Nabil Bank (for eligible payments). We do not store your full card number.
- Airline tickets usually require payment in full before they can be issued. Tours, group bookings and some other services may require a deposit, with the balance due by the date we tell you in writing.
- If full payment is not received by the due date, we may cancel the booking. Any Supplier cancellation fees and our reasonable costs may then be deducted from money you have paid, as permitted by law.
- If you dispute a card payment with your bank (a chargeback) for services that were provided, we may provide your booking records to the bank to respond to the dispute.
6. Changes, cancellations and refunds
Changes, cancellations and refunds depend on the Supplier's rules and your fare type. Many discounted airfares are non-refundable and allow limited or no changes. Full details are set out in our Refund and Cancellation Policy, which forms part of these Terms.
7. Changes or cancellations by Suppliers
- Airlines and other Suppliers may change schedules, aircraft, routes or services, or cancel services. We will pass on any notice we receive from a Supplier as soon as practicable, using the contact details you gave us.
- Where a Supplier cancels or significantly changes your booking, you will be entitled to the alternatives, refunds or compensation that the Supplier offers or is required to provide. We will help you with this process.
- Rights to compensation for delays, cancellations, lost baggage and injury on international flights are generally governed by the airline's conditions of carriage and international conventions, including the Montreal Convention. Claims of this kind are made against the airline.
8. Passports, visas, health and travel requirements
- You are responsible for holding a valid passport (many countries require at least six months' validity), the correct visas for your destination and every transit country, and any required health documents.
- We can give general information and, where you have booked our visa assistance service, help you apply. However, visa decisions are made by governments and we cannot guarantee that a visa or entry will be granted. Government visa fees are not refundable by us.
- Entry, transit and health rules change frequently. Check the latest official information before you travel, including Smartraveller and the relevant embassy or immigration authority.
- If you are refused boarding, transit or entry because of missing or incorrect documents, the costs are your responsibility, except to the extent caused by incorrect advice from us.
9. Travel insurance
We strongly recommend that every traveller buys comprehensive travel insurance at the time of booking, covering cancellation, medical expenses, evacuation, baggage and personal liability. Many cancellation costs cannot otherwise be recovered.
10. Special assistance, baggage and check-in
- Tell us about any mobility needs, medical conditions, dietary requirements or special assistance requests when you book. We will pass them on to the Supplier, but provision is at the Supplier's discretion and cannot be guaranteed.
- Baggage allowances, seat selection and on-board services are set by the airline and depend on your fare. Check your e-ticket or ask us.
- You are responsible for checking in on time and complying with airline, security and customs requirements. Missing a flight may result in the remaining flights on your ticket being cancelled by the airline.
11. Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded or limited.
Where the law allows us to limit our liability for a failure to comply with a consumer guarantee (for example, for services not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
12. Limitation of liability
Subject to section 11 and to the maximum extent permitted by law:
- we are not liable for any act, omission, default or insolvency of a Supplier, or for loss caused by a Supplier, except to the extent the loss is caused by our own negligence or breach of these Terms;
- we are not liable for any indirect or consequential loss, including loss of enjoyment, income or opportunity, except to the extent that it was reasonably foreseeable and caused by our negligence or breach;
- our total liability to you in connection with a booking is limited to the amount you paid us for that booking.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.
13. Events outside our control
We are not responsible for failing to perform our obligations where this is caused by events beyond our reasonable control, such as natural disasters, severe weather, pandemics, war, terrorism, civil unrest, strikes, government action, airline or airport shutdowns, or system outages at airlines or booking systems. In such cases we will do what we reasonably can to help you and to pursue any refund or credit a Supplier makes available.
14. Use of our website
- Information on our website, including prices, schedules, travel tips and blog articles, is general information only and may change. It is not legal, immigration, medical or financial advice.
- You must not misuse the website, including by attempting unauthorised access, scraping, interfering with its operation or making speculative, false or fraudulent bookings.
- Content on the website, including text, images, logos and design, is owned by or licensed to us and may not be copied or reused without our permission.
- Links to third-party websites are provided for convenience; we are not responsible for their content.
15. Feedback and complaints
If something goes wrong, please contact us as soon as possible, ideally while you are travelling, so we can try to fix it. If you have a complaint:
- Email info@skytrips.com.au with your booking reference and details. We will acknowledge your complaint within 2 business days and aim to respond in full within 14 days.
- If a complaint concerns a Supplier, we will pass it on and help you seek a resolution.
- If you are not satisfied with our response, you may contact NSW Fair Trading or your local state or territory consumer protection agency, or the Australian Competition and Consumer Commission (ACCC). Privacy complaints may be made to the Office of the Australian Information Commissioner (OAIC).
16. Privacy
We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Airlines and other Suppliers, some of which are overseas, require travellers' personal information to provide their services.
17. General
- Changes to these Terms. We may update these Terms from time to time. The version published on our website when you make a booking applies to that booking.
- Severability. If any part of these Terms is invalid or unenforceable, it will be read down or severed, and the rest will continue to apply.
- Governing law. These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales. This does not remove any right you have under the consumer laws of the place where you live.
